FSSAI Registration and License

What exactly is the FSSAI?

The Food Safety and Standards Authority of India is abbreviated as FSSAI. This organization strives to secure India’s food-related legislation and, as a result, sets standards for Food Business Operators (FBO) in the food industry.

According to the Act, no one may start a food business without first obtaining FSSAI approval. Whether or whether a person should apply for Registration or a License is determined by a number of factors, as detailed below:

Registration:

To be eligible for registration, you must meet the following criteria:

The majority of people believe that forming a single proprietorship is a profitable approach to start a food business. FSSAI registration is a baseline license that all Petty Food Business Operators are expected to have. Those who own a petty food business include:

  1. Whoever creates or sells food, or who works as a tiny retailer.
  1. What is the difference between hawkers, itinerant vendors, and temporary stall-holders?
  1. Food-related cottage industries are small-scale or home-based businesses.
  • Having a turnover of less than Rs.12 lakhs per annum.
  • Food production capacity (excluding milk and milk products, as well as meat and meat products) is limited to 100 kg/litre per day.
  • Milk is procured, handled, and collected in quantities of up to 500 litres each day.
  • A maximum of two large animals, ten small animals, or 50 poultry birds can be slaughtered per day.

Documents required for submitting an application for registration:

  • FBO’s photo identity.
  • Proof of possession of the business location, such as a lease agreement or a letter of authorization.
  • To be dealt with is the product list.
  • Incorporation Certificates, Partnership Deeds, and other forms of business formation are available.
  • The Food Safety Management System is stated in the plan.
  • Form A has been filled out and signed.

The FSSAI registration procedure is as follows:

  1. The applicant must submit Form A, which must be completed and signed, to the Food and Safety Department.
  1. Within 7 days of submitting the application, the applicant will be notified in writing whether the application has been accepted or denied.
  1. If the application is approved, a registration certificate containing the applicant’s registration number and photo will be issued.

During business hours, this certificate should be displayed at the place of business.

Licenses: Other than those listed above, food business operators must get an FSSAI license. Based on the size of the firm, this license can be further divided into two categories: state and central FSSAI license.

Central Permit: The Central FSSAI license is required for large food business operators, manufacturers, and importers. The following is a comprehensive list of FBOs that require a Central License:

  • Restaurants with a yearly revenue of more than Rs.20 crores.
  • Caterers with a yearly revenue of more than Rs.20 crores.
  • Vending machine companies with more than 100 machines or machines in two or more states.
  • Units with a capacity of more than 10,000 MT of cold storage.
  • A food storage facility with a capacity of over 50,000 MT.
  • Activity in the food service industry at airports, seaports, and railway stations.

Obtaining a Central License requires the following documents:

  • Completed and signed Form-B.
  • Area location blueprint, including dimensions and operation-by-operation area allocation.
  • Owner/Partners/Directors’ Contact Information
  • If appropriate, sources of raw ingredients like milk, meat, and so on.
  • Possession of the property must be proven.
  • Proprietor/Partner/photo Director’s ID and proof of address
  • Names and descriptions of the equipment and machinery used, as well as their numbers and capacities.
  • This is a list of products that are going to be made.
  • If applicable, provide a certificate from the Ministry of Tourism.
  • 100% EOU MCA Certificate
  • The FSSAI Department has given a NOC.
  • To assess the portability, obtain a water report from a reputable health laboratory.
  • If applicable, provide proof of vehicle turnover.
  • DGFT has produced an IE code document.
  • The manufacturer’s licence copy/NOC
  • A letter of authorization from an authorised local body or municipality is required.
  • A report of pesticide residues in water from a recognised public health centre is necessary for units producing carbonated water.
  • If applicable, proof to support Turnover.
  • Form for the FSSAI Declaration.
  • The Food Safety Management System is stated in the plan.

State License:

All FBOs that do not qualify for a Central License or an FSSAI Registration must obtain a State License. The following is a comprehensive list of FBOs that require a state license:

  • Restaurants and bars with annual sales of up to Rs.20 crores.
  • Food retailers and suppliers with annual sales of up to Rs.20 crores.
  • Cold storage facility with a yearly revenue of more than Rs.12 lakhs.
  • A storage facility having a yearly revenue of more than Rs.12 lakhs.
  • Food transporters with a fleet of up to 100 vehicles and annual revenues of up to Rs.30 crores.
  • Milling units for all grains, cereals, and pulses, with no limit on production capacity.

Documents required for getting a state licence include the following:

  • Form B has been dutifully filled and signed.
  • Blueprint of the area layout, including dimensions and operation-by-operation allocation.
  • Proprietor/Partners/Directors’ contact information, photo ID, and proof of address.
  • This is a list of products that will be manufactured.
  • Name and address of the responsible person are included in the authority letter.
  • A report of pesticide residues in water from a recognised public health centre is necessary for units producing carbonated water.
  • Affidavit of Proprietorship/Partnership Deed/Memorandum of Association.
  • The name and quantity of pieces of equipment and machinery used, as well as their installed capacity.
  • The manufacturer’s licence copy/NOC
